RESIDENTS, 18 YEARS OF AGE AND OLDER. VOID IN PUERTO RICO
AND WHERE PROHIBITED. |
SPONSOR:
Warner Bros. Online. "Sponsor and its agents"
shall mean Warner Bros. Online, advertising and promotional
agencies and their respective officers and agents. |
ELIGIBILITY:
This Contest is open to legal U.S. residents (excluding Puerto
Rico) who are 18 years of age or older and who had Internet
access on or before May 29, 2003. Employees of AOL Time Warner,
Inc., Warner Bros Entertainment Inc., Warner Bros. Online
Inc., Warner Bros. Television, and The WB Network and each
of their respective parent companies, affiliates, subsidiaries,
divisions, and advertising and promotional agencies and their
respective officers and agents and the immediate family members
and persons living in the same household of each are not eligible. |
HOW
TO ENTER: This Contest begins at 12:00:01 a.m. PST
on May 30, 2003, and ends 11:59:01 p.m. PST on July 4, 2003.
To enter the Contest, go to www.alexandemmamovie.com and click
on “short story contest” and you will be asked
to electronically sign a submission agreement, then you will
be prompted to enter your name, email address, phone number,
zip code, and age, to tell us about yourself (optional) and
to submit a short story which you have written (collectively,
the "Entry"). |
CONTEST REQUIREMENTS: Each short story submitted
must meet all of the following requirements to be eligible
for consideration : (1) in keeping with the theme of the movie,
Alex & Emma, the subject matter must be romantic comedy;
(i.e., a dramatic premise which includes elements of humor
and romance); (2) it must be an original work of fiction which
you have written; (3) it must be in the English language;
and (4) it must be less than 1000 words in length. Short story
submissions which do not meet all of these requirements will
be automatically disqualified. Only one Entry per person and
per e-mail address. No joint submissions. In the event that
more than one Entry is submitted, only the first Entry will
be considered. |
By
entering, entrants agree to comply with these official rules
including all eligibility requirements. Illegible and/or incomplete
Entries and Entries submitted by entrants who do not meet
the eligibility requirements (including all requirements with
respect to age and residence) are void. Sponsor and its agents
are not responsible for lost, late, or misdirected Entries,
for technical, hardware or software failures of any kind,
for lost or unavailable network connections, or for failed,
incomplete, garbled or delayed computer transmissions or any
human error which may occur in the receipt or processing of
the Entries. Proof of entering information at website does
not constitute proof of delivery or receipt. Sponsor reserves
the right to modify any dates set forth in these Contest rules
without prior notification. Use of computer programs and other
automatic means to enter the Contest is prohibited and may
result in the disqualification of the entrant. In the event
of a dispute regarding the identity of the person submitting
an Entry, the Entry will be deemed to be submitted by the
person in whose name the e-mail account is registered on the
date the Entry is submitted. All Entries become property of
the Sponsor and will not be returned. |
JUDGING
CRITERIA AND PROCEDURES, WINNER SELECTION AND NOTIFICATION:
5 semi-finalists will be selected and may be listed on www.alexandemmamovie.com
on or about August 18, 2003, and a winner announced on or
about September 5, 2003 by a process in which all eligible
entries will be ranked by one or more members of a panel of
qualified judges headed by Rob Reiner, the director of the
movie, Alex & Emma. Entries will be ranked according to
the following criteria: originality, writing style, storytelling
skill/structure and authorial voice (i.e., exhibiting professional
quality in writing). Each area will be given equal weight.
Entrants can receive up to a possible 6 points in each area
and a possible total score of 24 points. In the event of a
tie, Rob Reiner will make the final decision. The judges'
decisions are final on all matters relating to the Contest.
In order to be declared the official winner, the entrant whose
Entry receives the highest ranking (“the Unconfirmed
Winner”) must be available to be contacted via telephone
or email. If Sponsor is not able to contact the Unconfirmed
Winner due to an incorrect email address or phone number,
a disconnected/invalid line, or a malfunctioning message service,
the Prize will be immediately and automatically forfeited
and an alternate Unconfirmed Winner will be selected. Once
contacted by Sponsor, the Unconfirmed Winner will be asked
to provide his/her address, whereupon Sponsor will send to
that address, a prize notification/publicity release (the
“Release”), which winner must sign and return
within 24 hours of receipt of the Release. Return of any Release
as undeliverable, or a failure to return any Release within
the time period stated in the Release, will result in disqualification,
and an alternate Unconfirmed Winner will be selected. Time
is of the essence with regard to the verification process
described in this paragraph, and the Unconfirmed Winner must
respond within the above-stated time period, or the Unconfirmed
Winner will be disqualified, and an alternate Unconfirmed
Winner will be selected. |
PRIZES
AND ODDS OF WINNING: |
PRIZE:
The winner will receive a Fujitsu® LifeBook® s6000
laptop computer (Approximate Retail Value “ARV”
$1,600), and a trip for winner and a guest to Los Angeles,
California. Trip includes round trip coach air transportation
for two (2) people from the major commercial airport nearest
the winner’s residence, ground transportation for winner
and his/her traveling companion between airport, hotel and
Warner Bros. Studios, 3 days/2 nights (single room/double
occupancy) hotel accommodations at a hotel selected by Sponsor,
a VIP tour of Warner Bros. Studios and a meeting with Rob
Reiner, director of Alex & Emma, in Los Angeles at a location
to be determined by Sponsor (ARV $2,800) (the “Prize”).
If the winner’s guest is a minor (as defined by the
minor’s state of residence), then the winner must be
the guest’s parent or legal guardian. Expenses such
as ground transportation between the winner’s residence
and airport, phone calls, purchases, airport surcharges, departure
taxes, and all other expenses not specifically listed are
not included. Guest must sign and return a Liability and Publicity
Release which must be received by Sponsor at least 30 days
prior to travel, or guest will not be able to accompany the
winner on the trip. The trip must be taken within one year
from the time the winner is confirmed by Sponsor and must
coincide with Rob Reiner’s availability, with final
dates to be determined by the Sponsor (Total ARV is $ 4,400).
No cash redemption or prize substitution allowed, except at
the Sponsor’s sole discretion. Prize is non-transferable.
All federal, state, and local taxes related to the Prize are
the winner’s sole responsibility. Winner will be issued
a 1099 tax form for the ARV of the Prize. Odds of winning
depend on the number of eligible entries received. The Prize
will be awarded. |
GENERAL
CONDITIONS: By entering, entrants agree: (a) to be
bound by the Official Rules, the decisions of the judges,
and the
Warner Bros. Online Privacy Policy1
(b) to release and hold harmless Sponsor and its agents from
any and all claims, demands, damages, losses or liabilities
caused by, arising out of, or related to their participation
in the Contest and/or their participation in any Prize-related
activities (including, without limitation, any property loss,
damage, personal injury or death); and (c) to be contacted
by Sponsor via e-mail. By accepting the Prize, winner consents
to the use of his/her name and/or likeness for advertising
and promotional purposes without additional compensation (except
if winner is a resident of TN or where prohibited by law).
The Sponsor reserves the right to make changes or additions
to these Official Rules and/or extend the dates of this Contest
at any time. |
| INTERNET:
If for any reason the Contest is not capable of running as
planned, including infection due to computer virus, bugs,
tampering, unauthorized intervention, fraud, technical failure,
human error or any other causes beyond the control of Sponsor
that corrupt or affect the administration, security, fairness,
integrity, or proper conduct of the Contest, Sponsor reserves
the right to disqualify any individual who tampers with the
entry process, and to cancel, terminate, modify, or suspend
the Contest without notice and to select the winner from all
eligible entries received prior to the cancellation or termination.
Sponsor is not responsible for any problems or technical malfunctions
of any telephone network or lines, computer online systems,
servers, or providers, computer equipment, software, failure
of any e-mail or entry to be received by Sponsor on account
of technical problems or traffic congestion on the Internet
or at any web site, any combination thereof, or otherwise,
including any injury or damage to any entrant's or any other
person's computer related to or resulting from participation
in the Contest. |
CAUTION:
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE
OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST MAY
BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH
AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES
FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. |

Glendale, CA 91203, to be received by August 18, 2003. |
DISPUTES:
Each entrant agrees that (1) any and all disputes, claims,
and causes of action arising out of or in connection with
this Contest, or any prizes awarded, shall be resolved individually,
without resort to any form of class action, and any judicial
proceeding shall take place in a federal or state court in
Los Angeles County, California; (2) any and all claims, judgments,
and awards shall be limited to actual out-of-pocket costs
incurred, including costs associated with entering this Contest,
but in no event attorneys fees and (3) under no circumstances
will entrant be permitted to obtain awards for, and entrant
hereby waives all rights to claim punitive, incidental, and
consequential damages, and any other damages, other than for
actual out-of-pocket expenses, and any and all rights to have
damages multiplied or otherwise increased. All issues and
questions concerning the construction, validity, interpretation
and enforceability of these Official Rules, or the rights
and obligations of entrant and the Sponsor in connection with
this Contest shall be governed by, and construed in accordance
with the laws of the State of California, without giving effect
to any choice of law or conflict of law rules or provisions
(whether of the State of California or any other jurisdiction),
that would cause the application of the laws of any jurisdiction
other than those of the State of California. |
